This page contains an Agreement document between you and MTVA which organize using and accessing MTVA's website "MTVA.com" (hereinafter referred to as "the site") in accordance with the terms and conditions .

Please read these terms and conditions carefully as they are the terms of use for this site as provided by MTVA.

1- User Obligation:

By using and/ or visiting the site, you hereby indicate your acknowledgement and assent to these terms and conditions (the "Terms of Service") and any other terms and conditions MTVA may introduce to use this site from time to time. MTVA reserves the right to amend these terms and conditions at any time by posting changes online and it is your responsibility to refer to and comply with these terms whilst accessing or using this site. If you do not agree to any of these terms, please cease from using this site immediately.

If there is any conflict between these Terms and Conditions and rules and/ or specific terms of use appearing on this site relating to specific material then the latter shall prevail. These Terms of Service apply to all users of  this site, including users who are also contributors of video content, information, and other materials or services on the website.

2-Copyright  and Other Intellectual  Property:

The names, images and logos identifying MTVA, the mother company, the subsidies, associated or sister companies or any other third parties or their products or services are proprietary marks of MTVA, or the mother company, its associated companies and/ or third parties concerned. Nothing contained herein shall be construed as conferring by any means, license or right under any trade mark or patent of MTVA, its associated companies or any other third party.

All copyright, trade marks and other intellectual property rights in this site (including the design, arrangement and look and feel) and all material or content supplied as part of this site shall remain at all times property of MTVA or the mother company, or  MTVA's subsidiaries or licensors. In accessing this site, you agree that your use of this Site as permitted is solely for your own personal, non-commercial use; and that you will not copy, distribute, reproduce, download, post, store (including in any other website), transmit, broadcast, commercially exploit, alter or modify in any way the material or content unless as authorized by MTVA.

Accessing some features of this site may require you to create an account. Use of such account shall be restricted to the account holder and individuals to whom the account holder has permitted the right of access. When creating your account, you undertake that you will provide accurate and complete information, and you are solely responsible for the activity that occurs on your account, and must notify MTVA immediately of any breach of security or unauthorized use of your account. Although MTVA shall not be liable for any losses caused by any unauthorized use of your account, you may be liable for MTVA or other parties' losses resulting from such unauthorized use.

3- Data Posting:

MTVA permits the users to submit through its site videos or other communications and data, opinions or audio material other to be broadcasted either on its website or on its Television channel ("user submissions"); MTVA also permits the hosting, sharing and/ or public use of such content.

The User who submits the above material accepts to give the right of license to MTVA to distribute the content as per their discretion and on their website and satellite TV station. Such content and distribution thereof shall always be subject to the following conditions:

3-1 Any information of data you transmit or post on this site (including any photographs, videos, audio material, written scripts, opinions or other forms of material) will not be treated as confidential and shall belong absolutely to MTVA. The information you submit may be used by MTVA for any purpose including, but not limited to, reproduction, disclosure to third parties, broadcasting, transmission, editing, cutting, reformation, adapting in a new form, posting or otherwise at MTVA's absolute discretion. You hereby assign to MTVA (by way or permanent assignment of present and future copyright) all rights of any nature in and to such material throughout the world including all renewals and reversions thereof.

3-2 You shall be solely responsible for your own submissions and the consequences of posting and publishing them, including any legal action or proceeding started by any third party as a result of the submission.

3-3 By submitting a video or an audio material, the Submitter affirms, represents, and warrants that he/ she owns or have the necessary licenses, rights, consents, and permissions to use and authorize us to use all patents, trademarks, trade secret, copyright or other proprietary rights in and to any and all user submitted content. He/ she further warrants that he has obtained all necessary consents and clearances from the people and third party right holders who may have any interest in the material submitted including all persons videoed in the submissions and their guardians.

3-4 The Submitter understands and indemnifies MTVA and all its employees, the mother company, affiliates, subsidiaries and associates from any and all damages, liabilities, third party action that may result from the public display and re- distribution of the content submitted by the Submitter due to the nature of the content, its invasion or breach of the privacy regulations which have resulted in damages to third parties (such as the individuals videoed on the submission).

3-5 The Submitter undertakes that he will not submit material that is copyrighted, protected by trade secrets or otherwise subject to third party proprietary rights, including Privacy and publicity rights, unless all rights and permissions from the rightful owners have been obtained to display the material and grant MTVA the below License. The Submitter undertakes as well that he will not submit material that is false, misrepresents or could cause damage or defamation to any third party, the submitter will not submit unlawful, obscene, defamatory, libelous, political, threatening, pornographic, harassing, hateful, racially offensive or encourages any criminal conduct that could be considered as a criminal offence, give rise to civil liability, or violate the law, local culture, international acceptable norms and codes of ethics.

3-6 The Submitter also grants to MTVA a worldwide, non- exclusive, royalty- free, transferable and sub- licensable license to broadcast, distribute, display, reproduce, cut, edit, re-edit, sell or modify the material submitted by the Submitter without limitation in any media format and through any media channel in all the territories in the World. This License is unlimited by time and territory, and is not revocable or limited through any method whatsoever, this license is exclusive to MTVA and its subsidiaries, associates, sister companies, and may only be licensed for use by a party designated by MTVA.

3-7 MTVA has designated its legal counsel to receive notifications of claimed infringements that User Submissions may commit; at: Al Quoz Industrial Area, P. O. Box 500666, Dubai, U. A. E. to the attention of the Legal Department. This address is designated for all notices of copyright infringement only, any comments, requests and other communications shall be directed to the MTVA customer service address indicated at the site.

3-8 You understand that when using this site, you will be exposed to User Submissions from a variety of sources, and that MTVA is not responsible for the accuracy, usefulness, safety, or intellectual property rights of or relating to such User Submissions. You further understand and acknowledge that you may be exposed to User Submissions that are inaccurate, offensive, indecent, or objectionable, and you agree to waive, and hereby do waive, any legal or equitable rights or remedies you have or may have against MTVA with respect thereto, and agree to indemnify and hold MTVA, its Owners/ Operators, affiliates, and/ or licensors, harmless to the fullest extent regarding all matters related to your use of the site.

3-9 MTVA has the final say, at its sole discretion, to display the User Submission at this site, or broadcast it on its Television channel. MTVA is under no obligation to display a user submission, and may decide at its own discretion to broadcast only a part of, or an amended, cut, or modified part of the User Submission on any media platform it deems appropriate.

4- Terms of Use:

You may only use this site for lawful purposes, in a manner which does not infringe the rights of or restrict or inhibit the use and enjoyment of this site by any third party. Such restriction or inhibition includes, but in not limited to, conduct which is defamatory, or which may harass, cause distress or inconvenience to any person and the transmission of obscene, abusive of offensive content or interruption of the normal flow of dialogue within this site.

5- Disclaimer/ Limitation of  Liability:

5-1 You agree that your use of this site shall be at your sole risk and responsibility. To the fullest extent permitted by law, MTVA, its officers, directors, and agents disclaim all warranties, express or implied, in connection with the site.

5-2 MTVA makes no representation, endorsement or warranty of any kind, including but not limited to the implied warranties of satisfactory quality, fitness for purposes, non- infringement, compatibility, security and accuracy.

5-3 MTVA assumes no liability or responsibility for any errors, damages of any nature resulting form your access to and use of the site.

5-4 MTVA assumes no responsibility of liability for any injury, property damage of cost of any nature resulting from your access to and use of the site, or from any interruption, cessation, transmission of broadcast from our site or television station.

5-5 MTVA does not warrant, endorse or guarantee that the content posted on this site of the television station is of social, cultural and moral standards that are acceptable, and does not warrant that the User Submissions posted do not infringe any third party rights. Although MTVA does monitor the user submissions provided herein, you shall have the responsibility to clear all rights of thirds parties including and to obtain all necessary licenses and approvals to post such material and provide such license to MTVA. By submitting your User Submission, you have assumed responsibility for all damages, costs, and liabilities that may arise as a result from your submission, including all criminal and civil action.

5-6 The information and other materials included on the site may contain inaccuracies and typographical errors. MTVA does not warrant completeness of the information and material or the reliability of any statement or other information displayed or distributed through this site. You acknowledge that any reliance on any such statement or information shall be at your sole risk.

5-7 In no event shall MTVA, and/ or third parties be liable for any damages including, but not limited to, indirect or consequential damages or any damages including, but not limited to, errors or omissions, indirect or consequential damages or any damages whatsoever arising from use, loss of use, data or profits, whether in action of contract, negligence or other action, arising out of or in connection with your use of this site and your submission of content.

5-8 MTVA may terminate, change, suspend or discontinue any aspect of this site, including the availability of any features of this site, at any time without notice of liability.

5-9 In no event shall MTVA, its subsidies, officers, directors, employees or agents be liable to you for any direct, indirect, incidental, punitive or consequential damages whatsoever resulting from any errors, omissions mistakes, inaccuracies of content; including any personal injury or property damage of any nature, whatever may be the cause.

5-10 MTVA shall not be liable for User Submission or the defamatory, offensive or illegal conduct of you or any third party and that the Risk of Harm or damage from the forgoing rests entirely with you.

6- Indemnity:

You agree to indemnify and keep indemnified MTVA, the mother company, its subsidiaries, associate companies, officers, directors, employees and agents, from and against any and all claims, damages, expenses, losses, costs and liabilities (including but not limited to attorney's fees) arising from in any manner from your access and use of this site or your violation of these terms and conditions or of any third party rights, including without limitation any copyright, property, privacy or any other right. Furthermore, and most importantly, you hereby agree to indemnify MTVA from any claim that may arise for damage caused to a third party by your User Submission. This Indemnity shall survive the termination of these terms and conditions.

7- Ability to Accept Terms of  Service:

You hereby warrant that you are either more than 18 years of age, or possess legal parental consent, and are fully able and competent to enter into these terms and obligations.

8- Law and Jurisdiction:

These Terms and Conditions shall be governed by and constructed in accordance with the laws of the United Arab Emirates. Disputes arising here from shall be exclusively subject to the jurisdiction of the Dubai Courts. Any cause of action you may have with respect to your use of this site must be commenced within one (1) year after the claim or cause of action arises.

If any of these Terms and Conditions should be determined to be illegal, invalid or otherwise unenforceable by reason of the law of any state or country in which these Terms and Conditions are intended to be effective, then to the extent and within the jurisdiction in which that Term or Condition is illegal, invalid or unenforceable, it shall be severed and deleted from that clause and the remaining terms and conditions shall survive and continue to be binding and enforceable.

MTVA makes no representation that materials on this site are appropriate or available for use at locations outside of the United Arab Emirates and access to them from territories where their contents are illegal is prohibited. If you access this site from a location outside of the United Arab Emirates, you are responsible with all local laws.
